Please read these Terms of Service ("Terms") carefully before using the Nod mobile application or website (together, the "Service"). By creating an account, logging in, or otherwise using Nod, you agree to these Terms and our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
1. About Nod
Nod helps people nearby share what they are open to — a coffee, a conversation, an activity — and chat when both sides say yes. To find people physically near you, Nod uses Bluetooth Low Energy and your device’s location to match active Nods in your area. The Service is operated by Nod ("we", "us", "our").
2. Eligibility and age
You must be at least 17 years old to use Nod. By using the Service, you confirm that you meet this requirement and that the date of birth you provide is accurate. We may terminate accounts of users who misrepresent their age. Nod is not intended for children under 17.
3. Your account
- You are responsible for maintaining the security of your account credentials.
- You may not share your account with others or create accounts on behalf of others without permission.
- You must provide accurate information (including your name, email, and date of birth) when creating an account.
- Notify us immediately at support@gonod.app if you suspect unauthorised access to your account.
4. Licence to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Nod app for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code, except as permitted by applicable law.
5. Acceptable use
You agree not to:
- Use Nod for any unlawful purpose
- Harass, intimidate, threaten, stalk, or abuse other users
- Post hate speech, sexually explicit content involving minors, or content that promotes violence or illegal activity
- Impersonate any person or entity, or misrepresent your affiliation
- Send spam, unsolicited messages, or automated messages
- Interfere with or disrupt the Service or its servers
- Attempt to reverse-engineer, decompile, or extract source code (except as permitted by law)
- Use Nod to collect data about other users without their consent
- Post content that is illegal, offensive, defamatory, or infringes intellectual property or privacy rights
- Circumvent safety features (including reporting, blocking, or content filters)
- Contact someone who has blocked you, or continue unwanted contact after they have declined
6. User content, safety, and moderation
Nod includes user-generated content ("UGC"), including Nod text, profile names, profile photos, and chat messages. This section describes your rights and our safety practices.
6.1 Your content
You retain ownership of content you create. By using Nod, you grant us a limited, non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display, and transmit your content solely as necessary to operate the Service. We do not claim ownership of your content.
You are solely responsible for the content you post and send. We are not responsible for content posted by other users.
6.2 Automated filtering
Nod uses automated tools to help detect and block profanity and other objectionable content in Nod text, profile names, and messages before or when it is posted. Automated filtering is not perfect and does not guarantee that all harmful content will be prevented.
6.3 Zero tolerance
Nod has zero tolerance for objectionable content and abusive users. We may remove content and suspend or permanently terminate accounts at our discretion, with or without notice.
6.4 Reporting
You can report another user or their content in the app:
- Nearby — swipe left on a Nod, then tap Report
- Chat — open a conversation, then use Report from the chat menu
- Profile — open a person's profile, then use Report
Reports are sent to Nod for review. For urgent safety concerns you may also email support@gonod.app with the subject line "Safety report".
6.5 Blocking and hiding
- Report — flags a user or content for our review. You may choose to block the person at the same time.
- Block — stops interaction, removes the person from your feed, and notifies us so we can review the account. Blocking is available from Chat and Profile, and optionally when submitting a Report.
- Hide — removes someone from your Nearby list only. Hide does not notify us or affect other users' experience.
Blocking or hiding someone removes them from your experience immediately. Removing a user from Nod for everyone requires our moderation action after review.
6.6 Our response to reports
We review reports within 24 hours. We may remove content, issue warnings, suspend accounts, or permanently ban users who violate these Terms. We may retain report data for safety, security, and legal purposes as described in our Privacy Policy.
6.7 Real-world interactions
Nod facilitates introductions between people nearby. You are solely responsible for your interactions with other users, including any meetings in person. Use your judgment, meet in public when meeting someone new, and contact local authorities in an emergency. We do not screen users' criminal histories and do not guarantee the conduct or identity of any user.
7. Privacy
Your use of Nod is subject to our Privacy Policy, which explains what information we collect, how we use it, and the choices you have.
8. Service availability and changes
We will endeavour to keep Nod available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice.
9. Intellectual property
All intellectual property in the Nod app, website, and brand (including the logo, wordmark, and design) is owned by Nod or its licensors. Nothing in these Terms grants you rights to use our intellectual property without prior written consent.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
11. Limitation of liability
To the maximum extent permitted by applicable law, Nod shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or any interaction with other users.
12. Termination
We may suspend or terminate your account at any time if we believe you have violated these Terms or pose a risk to other users or the Service. You may delete your account at any time from within the app: Profile → Security → Delete Account. When your account is deleted, your profile and related content are removed as described in our Privacy Policy. Abuse reports may be retained for safety and legal purposes.
13. Third-party platforms
If you downloaded Nod from the Apple App Store or Google Play, you must also comply with the applicable store's terms of service. Apple and Google are not parties to these Terms, are not responsible for the Service, and have no obligation to provide maintenance or support for the app.
14. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to these Terms
We may update these Terms as the product evolves. We will notify you of material changes via the app or email. Continued use of Nod after changes take effect constitutes acceptance of the updated Terms.
